Pima County is considering buying the Spanish Trail Motel, a move that could resolve South Tucson’s lawsuit against landlord Brian Bowers over fires, crime, and lingering asbestos at the property.

Pima County is planning to purchase the troubled Spanish Trail Motel, a move that could bring an end to South Tucson’s lawsuit against landlord Brian Bowers.

On August 5, the city filed a motion saying the parties jointly requested a 30-day extension on a scheduled hearing, noting that the county “is expected to purchase the property.”

The motion adds that South Tucson anticipates dismissing the case if the sale goes through, with an update expected during the 30-day period.

The motel has been plagued by asbestos and repeated fires, with records showing hazardous materials still present on the site despite county permits for removal.

The city of South Tucson sued Bowers in May, asking a judge to order demolition of the property, which they call a “public nuisance” that continues to endanger neighbors.

Court filings cite more than two dozen fires since 2020, including one that spread into nearby apartments, as evidence of ongoing risks.

Bowers has dismissed the city’s claims as allegations, arguing that asbestos does not pose a health hazard unless disturbed. He said he is working with the county and outside groups on a cleanup plan.

Still, South Tucson contends it has exhausted attempts to resolve the matter without legal action, pointing to exposed asbestos, crime and persistent fire hazards as justification for court intervention.

The parties are expected to update the court next month on whether the potential county purchase will resolve the dispute.
